1. INTRODUCTION

2. NATURE OF SERVICES
Evergreen provides:
- Air ambulance coordination and operations
- International medical repatriation
- Commercial airline stretcher transfers
- Medical escort services (Doctor / Nurse / Paramedic)
- Fit-to-fly medical assessments
- Community emergency preparedness programs
- First aid, BLS, ACLS, and related training programs
We operate globally and coordinate with third parties including airlines, hospitals, aviation authorities, embassies, and insurers.
3. NO GUARANTEE OF OUTCOME
Due to the clinical and aviation-sensitive nature of services:
- Evergreen does not guarantee medical outcomes.
- Evergreen does not guarantee airline approvals.
- Evergreen does not guarantee visa, embassy, or regulatory clearances.
- Evergreen does not guarantee recovery or survival outcomes.
Medical transport involves inherent clinical and operational risks.
4. MEDICAL RESPONSIBILITY & LIMITATIONS
- Evergreen provides medical services through licensed professionals.
- Clinical decisions are based on information provided by the referring hospital, patient, or family.
- Evergreen relies on the accuracy of medical records submitted.
- Evergreen is not liable for:
- Incomplete or inaccurate medical information
- Undisclosed medical conditions
- Pre-existing deterioration prior to transfer
- Unforeseen medical complications during transport
- Incomplete or inaccurate medical information
Medical transfers are performed under internationally accepted emergency medicine and aviation protocols.
5. THIRD-PARTY DEPENDENCY
Our services depend on third parties including:
- Airlines
- Charter operators
- Ground ambulance providers
- Hospitals
- Embassies
- Insurance companies
Evergreen is not responsible for:
- Airline delays or cancellations
- Airspace restrictions
- Weather-related disruptions
- Airport operational decisions
- Governmental or regulatory actions
6. PAYMENT TERMS
- Services require complete (100%) advance payment unless otherwise agreed in writing.
- Payment schedules will be defined in the service proposal.
- Refunds, if applicable, are subject to:
- Services already rendered
- Non-refundable aviation or operational bookings
- Administrative costs
- Services already rendered
Emergency mobilization costs are non-refundable once activated.
7. CANCELLATION POLICY
Cancellation after confirmation may result in:
- Forfeiture of deposits
- Recovery of incurred third-party costs
- Operational mobilization charges
Each case will be assessed based on stage of execution.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
Evergreen’s liability shall be limited to the total service fee paid for the specific engagement.
Evergreen shall not be liable for:
- Indirect or consequential damages
- Loss of opportunity
- Emotional distress
- Travel disruptions caused by third parties
- Force majeure events
Nothing in these Terms excludes liability where exclusion is prohibited by law.
9. FORCE MAJEURE
Evergreen shall not be liable for delays or failure caused by events beyond reasonable control, including:
- Natural disasters
- Political instability
- Airspace closures
- War or civil unrest
- Pandemics
- Government restrictions
- Aviation authority decisions
10. DATA PRIVACY
Personal and medical data are handled in accordance with:

- Applicable international data protection laws
By engaging our services, you consent to necessary processing and cross-border transfer of medical and operational information.
11. CONFIDENTIALITY
All medical information shared with Evergreen shall be treated confidentially.
Clients agree not to publicly misrepresent medical events or operational details in a manner that damages Evergreen’s reputation without lawful basis.
12. TRAINING PROGRAM TERMS
For first aid and emergency response training:
- Certification validity depends on attendance and assessment completion.
- Evergreen does not guarantee employment outcomes.
- Participants must disclose relevant medical conditions before physical training sessions.
13. INTELLECTUAL PROPERTY
All materials including Training content, Course manuals, Website content, Branding elements, etc. remain the intellectual property of Evergreen Health Solutions Private Limited.
Unauthorised reproduction or distribution is prohibited.
14. WEBSITE USE
Users agree not to:
- Misuse the website
- Attempt unauthorised access
- Upload malicious software
- Use content for unlawful purposes
15. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of India.
16. ARBITRATION
Any dispute arising from or relating to these Terms or services provided by Evergreen shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

- Arbitration award shall not be challenged by the user/client/patient/representative.
17. SEVERABILITY
If any provision is found invalid or unenforceable, the remaining provisions shall remain in effect.

Evergreen reserves the right to modify these Terms at any time. Updated Terms will be posted on the official website.
Continued or new engagement after modification constitutes acceptance.
